Terms and Conditions of Use


Thank you for visiting our website operated by Best World Lifestyle Sdn. Bhd. ("BWL", "we", "our") or using our mobile application ("App"). If you continue to browse and use BWL website or App, you are agreeing to comply with and be bound by the terms and conditions ("Terms") set forth herewith.

If you are under 18 years old, you must not access or use our website or App. Pursuant to the Contracts Act 1950 (Malaysia), persons under 18 years of age do not have legal capacity to enter into binding contracts. All purchases and registrations must be made by a parent or legal guardian acting on behalf of the minor.



Intellectual Property Rights

All contents on BWL websites and Apps, including but not limited to text, graphics, images, audios, videos, logos and other downloadable digital items are the properties of BWL or their content providers. They are protected by copyright laws. No part or parts shall be reproduced, displayed, republished, modified or transmitted in any manner or by any means or stored in an information retrieval system without prior written approval from BWL.


Access and Content Use

You are granted limited rights to access and use BWL websites or Apps for personal use. Unless otherwise expressed in written consent from BWL, the content use of BWL websites or Apps is subject to the following terms:

  • You may not download and/or modify the content on BWL websites or Apps other than for personal viewing.
  • You may not reproduce or copy BWL websites or Apps, or any of the material contained in it.
  • You are granted non-exclusive and revocable rights to create hyperlinks to BWL websites or Apps, provided it does not represent BWL, nor does it present BWL and its products and services as false, misleading, misrepresenting and offensive.
  • You may not make available any content of BWL websites or Apps by automated and/or manual means; in electronic and/or printed forms to other entities or persons.
  • You may not attempt to hack into, disrupt, disable or interfere with the services on BWL websites or Apps.

Your EXS Account

An EXS account is set up for you upon your successful registration as a BWL member. You are responsible for maintaining the confidentiality, accuracy and use of the account and password. We reserve the right to deny access to your account without prior notice given to you.

For the collection, use, disclosure and protection of your personal data kept with us, please read our PERSONAL DATA PROTECTION POLICY.


Product and Packaging

From time to time, we may modify and improve our product and/or its packaging. When making purchases from our online stores via BWL websites or Apps, you agree that the actual product you receive may have slight variance from its corresponding picture and/or specification presented on our websites or Apps. We are not in any obligation to supply product in the exact accordance to its corresponding picture and/or specification.


Pricing

All prices on Malaysia online store and offline store ("MY Store") are in Malaysian Ringgit (RM).

BWL strives to ensure that product prices and product details advertised on our online stores are correct and up-to-date. We reserve the right to vary the product prices and other product details without prior notice.

The prices on our online stores are for online purchases only.


Shipping

When making purchases from our online stores, shipping charges may apply. It is calculated based on the total weight of your ordered products, your shipping destination region and the selected shipping method. Weight of the products used may be actual or volumetric (bulky but light products), whichever is higher. You are responsible for the payment of all applicable shipping charges, unless indicated otherwise.

There will be free shipping for orders with minimum RM1900 spend per transaction.

Some regions impose a daily value limit for their import shipment. As such, large orders may be split and shipped separately in order to comply with the regions' regulations. As shipping charges reflect the latest rate adopted and may vary from time to time, we will not be able to notify you the exact charges in advance. Your understanding is appreciated. Due to various regulatory and business constraints, BWL and its shipping provider partners may not provide delivery to all regions in the world.

Where applicable, we will estimate and inform you the amount of time required for your shipment to arrive at your designated shipping address. Although we take every best effort to ensure your shipment arrives on time, this is however not guaranteed. The timeliness of your shipment is still subject to the customs clearance at the region of your shipping destination.

All orders via MY Store are typically delivered within 7 working days after the order is placed. In the event of any delays, we will notify you via email. For any missing items, please notify us within 5 days upon receipt of the order and we will arrange for a replacement accordingly.


Risk of Product Loss and Confiscation

BWL strives to engage the service of professional and reliable shipping providers to deliver products you order from our online stores. However, this does not guarantee you will eventually receive the products due to the risk of loss or confiscation. This risk is transferred to you after we ship out your order.


Order Cancellation and Amendment

When making purchases from MY Store, you may amend your order within the same day of purchase by 2359 hours, Malaysia Time (GMT+8). You are allowed to change the delivery address ONCE for orders that have not yet been shipped.

You may also cancel your order within a 10 working days cooling-off period from the date of purchase.

For any cancellations made, BWL reserves the right to adjust, cancel, withdraw bonuses, incentives and/or commissions that affect, including but not limited to, the buyer and/or his/her uplines.

For returns after receipt of products, please refer to the Exchange, Refund and Buy Back Policy section.


Cut-off Timing

The cut-off timing for all sales and registration of new members will be till the last day of every month, 2359 hours, Singapore time (GMT+8) except for the month of December which is subject to financial closure date.

All incentives and promotions will also strictly follow Singapore timing (GMT+8).


Exchange, Refund and Buy Back Policy

Exchange for Incorrect or Defective Products

  • When making purchases from our online stores or offline stores and receiving products that are incorrect or defective, you may request either an exchange or full refund. All exchanged products must be in their original packaging and accompanied by the original tax invoice. No administration fee will be imposed for exchange and return for incorrect or defective products.
  • For online store purchase, you must notify BWL within 10 working days from the date of purchase. After notifying BWL, incorrect or defective products must be returned to BWL within 10 working days. All shipping costs associated with exchanges will be covered by BWL.
  • For offline store purchase, you are encouraged to inspect your products before leaving the store. If any item is found to be incorrect or defective, an immediate exchange or full refund can be requested. If an incorrect or defective item is discovered after leaving the store, you may return to the store within 10 working days for an exchange or full refund.

Return and Refund for Dissatisfaction

  • You may return the products for a refund if you are dissatisfied with our products for any reason.
  • All returned requests must be submitted within 10 working days from the date of purchase.
  • After notifying BWL, returned products must be returned to BWL within 10 working days.
  • All returned products must be in good and saleable condition, accompanied by the original tax invoice.
  • All shipping costs associated with the returns will not be covered by BWL.
  • Any refunds made beyond the stipulated time period will be subject to processing fees. This may include an administration fee of RM90 or a fee equivalent to 10% of the Member Price (DP), depending on the timing of the cancellation. These fees will be directly deducted from the refund amount (transaction's total amount).
  • The refund process may take up to 3 weeks to complete.

Member Buy Back Policy

  • BWL's Buy-Back Policy complies with the recommendations of the Direct Selling Association of Malaysia (“DSAM”).
  • Upon termination of membership, members may return products purchased within 6 months or 180 days from the date of purchase.
  • All returned goods must be currently marketable, meaning that the products must be unopened, unused, unexpired, and in good and saleable condition, and must be accompanied by the original purchase invoice. BWL further reserves the right to reject any returned products that are not currently marketable.
  • An administration fee of 10% of the Member Price (DP) will be imposed on all returned goods.
  • This policy applies to unsold inventory purchased by members, not to products purchased for personal consumption.

For any exchanges, refunds, or buy-back transactions, BWL reserves the right to adjust, cancel or withdraw bonuses and/or incentives that affect, including but not limited to, the buyer and/or his/her uplines.


Bonuses

Qualified BWL members will be entitled to commissions, rewards, rebates, incentives and/or sharing (hereinafter referred to as Bonuses) resulting from the purchases on our online stores. For the purpose of calculating these bonuses, we will use the month in which you confirm your purchases, as the bonus calculation month. These bonuses will be paid out in the following month. The monthly cut-off time for this purpose shall fall on the last day of each month according to our website server system, Singapore time (GMT+8).


Disclaimer of Warranties and Limitation of Liability

BWL websites, Apps, its contents, downloadable items, products and services sold or made available to you through our websites or Apps are provided on an "As Is" and "As Available" basis. Unless otherwise expressed in writing, we make no warranty of any kind with regards to previous statement, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. We shall not be liable for errors contained on our websites or Apps, and for any direct, indirect, special, incidental or consequential damages of any kind arising from using our websites or Apps, all its contents, downloadable items, products and services sold or made available to you through our websites or Apps. Notwithstanding the foregoing, nothing in these Terms excludes or limits any rights or remedies that you may have under the Consumer Protection Act 1999 (Malaysia) or any other applicable mandatory consumer protection legislation in Malaysia, which cannot be excluded or limited by contract.


Electronic Communications

Due to the nature of all electronic communications whereby some internet transactions may be subject to interruption, transmission blackout, delayed transmission and incorrect data transmission, BWL shall not be liable for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of messages and transactions you send. By transmitting transactions, applications or documentation over the internet, you acknowledge and accept the risks inherent with this method of communications.


Governing Law

By using BWL websites or Apps, you agree that the above Terms are governed by applicable laws and regulations of the region for which the websites or Apps are operating. Any disputes arising from using BWL websites or Apps shall be resolved by negotiation, mediation or arbitration. Any disputes which were unable to be resolved via Alternative Dispute Resolution shall be finally resolved by the court within the governing jurisdiction.


Amendments to Terms and Conditions of Use

BWL reserves the right, in its sole discretion, to change, limit, amend or discontinue any aspect, contents, or features of our websites and Apps, as well as any aspect pertaining to the use of the websites and Apps. As such, we encourage you to review the Terms regularly to ensure that you are aware of any changes.
